1. Acceptance of Terms

By accessing, joining the waitlist for, creating an account on, or using Shuttertide ("Shuttertide," "we," "our," or "us"), you agree to these Terms of Service. If you do not agree to these Terms, please do not use the website, join the waitlist, or access the app.

2. Description of the Service

Shuttertide provides software for photographers and studios to manage galleries, proofing, downloads, client delivery, quotes, approvals, and related workflow tools. Some parts of the Service may be in early access, limited release, waitlist mode, beta, or otherwise unavailable to the public at certain times.

3. Waitlist and Early Access

When you join the Shuttertide waitlist, you ask us to contact you about access to the product. Joining the waitlist does not guarantee account approval, invite timing, product availability, or access to any specific feature.

We may approve, decline, delay, pause, or revoke waitlist or early-access participation at our discretion, including to manage product quality, support capacity, security, or misuse.

4. Waitlist Emails and Communications

By joining the waitlist or using the Service, you agree that we may send you emails related to your waitlist status, product announcements, launch updates, feature news, offers, promotional updates, service notices, and other communications about Shuttertide.

You can opt out of promotional or marketing emails at any time using the unsubscribe link in the email or by contacting us. Even if you opt out of promotional messages, we may still send you important transactional or service-related emails, such as access, account, billing, security, legal, or support messages.

5. Your Information and Third Parties

We do not sell your personal information, and we do not share your waitlist or account information with third parties for their own independent marketing or advertising.

We may use trusted service providers and infrastructure partners as necessary to host, operate, secure, analyze, support, and communicate about the Service. Those providers may process your information only to help us run Shuttertide and not for their own unrelated marketing purposes.

6. Accounts and Access

You are responsible for the accuracy of the information you provide and for maintaining the security of your login credentials and account. You are responsible for activity that occurs under your account unless caused by our own failure to maintain reasonable security controls.

We may require account verification, approval, or access restrictions before enabling some or all parts of the Service.

7. Acceptable Use

You agree not to misuse the Service. This includes, without limitation:

  • Using the Service in violation of any applicable law or regulation.
  • Uploading, sharing, or distributing content you do not have the right to use.
  • Attempting to interfere with the security, availability, or integrity of the Service.
  • Sending spam, malware, abusive content, or fraudulent communications through the Service.
  • Trying to gain unauthorized access to accounts, data, systems, or networks.

8. Content and Ownership

You retain ownership of the photos, media, text, branding, and other content you upload to Shuttertide ("Your Content"). We do not claim ownership of Your Content.

You grant us a limited, non-exclusive, worldwide license to host, store, process, display, transmit, and otherwise use Your Content only as needed to provide, secure, improve, and support the Service for you and your intended recipients.

You represent that you have the rights, permissions, and authority needed to upload and use Your Content in the Service.

9. Plans, Billing, and Changes

Some features may require a paid plan now or in the future. Pricing, plan limits, feature availability, trial access, and promotional offers may change over time. If you purchase a paid plan, you agree to provide accurate billing information and to pay all applicable charges under the terms presented at checkout.

Promotional offers, credits, discounts, and early-access pricing may be changed or withdrawn at any time unless we expressly state otherwise.

10. Availability and Beta Features

We may update, modify, suspend, or discontinue any part of the Service at any time. Features offered during launch, waitlist, or beta periods may change more frequently and may contain bugs, limitations, or interruptions.

11. Suspension and Termination

We may suspend or terminate access to the Service or the waitlist at any time if we reasonably believe you violated these Terms, created risk for the Service or other users, or if continued access is no longer operationally feasible.

12. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

13. Limitation of Liability

To the maximum extent permitted by law, Shuttertide and its affiliates, founders, employees, contractors, and partners will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, business, goodwill, use, or data arising out of or related to your use of the Service.

14. Changes to These Terms

We may update these Terms from time to time. When we do, we will post the updated version on this page and update the "Last Updated" date above. Your continued use of the Service after the updated Terms become effective means you accept the revised Terms.
